These terms are an agreement between you and [FILL: legal entity name] (ABN [FILL: ABN]), trading as DigiScalability ("we", "us"). We operate Insta Services — an Android app and website that connects people in Melbourne, Australia with local service providers such as plumbers, electricians, cleaners, tutors, gardeners and beauty professionals.
By creating an account or using the app, you agree to these terms. If you do not agree, please do not use Insta Services. You must be at least 18 to use the service.
Insta Services is a connection platform. We help people who need a service ("seekers") find and contact people who offer services ("providers"). That is the whole of our role.
To be very clear:
Some listings carry an ABN badge. Each badge means exactly this, and nothing more:
Neither badge means we have checked the business, verified who runs it, or confirmed it is licensed, insured or competent. You must do your own checks before hiring anyone.
Licensed trades: some work is illegal to perform without a licence or registration. In Victoria this includes plumbing, gasfitting and electrical work. Before this kind of work starts, ask the provider for their licence number and check it yourself with Energy Safe Victoria (electrical and gas) or the Victorian Building and Plumbing Commission (plumbing and building work). If a provider cannot show you a licence, do not let them do the work.
When you use Insta Services you must not:
Your content. You own the content you post — job briefs, messages, photos, reviews and profile details. By posting it, you give us a non-exclusive, royalty-free licence to host, display and share it as needed to run the service (for example, showing your job brief and photo to matched providers, or displaying your review on a provider's listing). Photos you attach to a job are stored at an unlisted web link — anyone who has the link can open it, and the link is shared with the providers we contact for that job. This licence ends when the content is deleted, except where we need to keep a copy to meet a legal obligation.
Moderation. We may remove content that breaks these terms, and we act on reports users file through the app. We do not pre-screen everything, so please report anything that shouldn't be there.
Some listings on the map were created by us from public data in the Australian Business Register (ABN Bulk Extract, published on data.gov.au under a CC BY 3.0 AU licence). For these listings:
Claiming a listing. A business owner can claim their listing and turn it into a normal provider account. To claim, you must confirm the business's ABN and provide your own contact details. Claiming a business that is not yours is a serious breach of these terms. We limit how many listings one account can claim, and we may reverse a claim that was made in error or in bad faith — for example, if someone claims a business that is not theirs.
The app includes an AI assistant. When you describe a job (with an optional photo), the assistant builds a job brief, selects matching providers, and sends each of them an introduction message on your behalf — through in-app chat and, where a provider has given us a phone number, possibly by SMS. Every such message is clearly labelled as coming from the assistant. When providers reply, the assistant summarises their responses and may recommend one, but nothing is booked until you confirm it — the contract is still directly between you and the provider (section 1). Keep in mind:
If you are a provider: by offering your services on Insta Services you agree that the assistant may send you enquiry messages on customers' behalf — in-app and, if you have given us a phone number, by SMS. Every SMS identifies Insta Services and tells you how to opt out (reply STOP).
How the AI processes your data is explained in our Privacy Policy.
Insta Services is currently free to use for both seekers and providers. If we ever introduce fees, we will give you clear notice before any fee applies, and you will be able to stop using the service before being charged anything.
Your consumer rights come first. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement.
Subject to that, and to the extent the law permits:
If you have a dispute with another user — over quality, payment, no-shows or anything else — please try to resolve it with them directly first. You can also report the other user in the app or email us; we may assist (for example by reviewing reports or removing a user who broke the rules), but we are not obliged to mediate or arbitrate disputes between users, and we cannot compel anyone to pay or to redo work. For consumer disputes, Consumer Affairs Victoria and VCAT are the appropriate avenues.
You can stop using Insta Services at any time and delete your account in the app or by the process on our account deletion page.
We may suspend or terminate your account if you breach these terms, use the service unlawfully, or put other users at risk. Where reasonable, we will tell you why. Sections of these terms that by their nature should survive (such as content licences needed for legal compliance, and the liability section) survive termination.
We may update these terms from time to time — for example when we add features. If a change is significant, we will notify you in the app or by email before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.
These terms are governed by the laws of Victoria, Australia, and disputes about them are subject to the courts of Victoria.
